Terms & Conditions.
Our standard terms of sale are being finalised with legal counsel. The working position below applies to trade and retail purchases — talk to us if your project requires a bespoke contract.
Parties
These terms cover purchases from Switchcom Distribution (Pty) Ltd, registered in South Africa, by retail and trade customers.
Orders + acceptance
Quotations are valid for 7 days unless otherwise stated. Orders are accepted only when we issue a written sales order or process payment. Stock allocation is first-come, first-served until confirmed.
Prices + tax
All prices are quoted in South African Rand (ZAR). Retail prices include 15% VAT; trade prices exclude VAT. Prices are subject to currency and supplier-cost fluctuation until the sales order is confirmed.
Payment terms
Retail: full payment due before dispatch. Trade: terms per your signed credit application, typically Net-30 with an 80% utilisation rule. Late payment may trigger account hold and interest at the rate prescribed under the Prescribed Rate of Interest Act (currently 11.75% per annum); the signed credit application may specify a higher contractual rate.
Title + risk
Title in goods passes to the customer on full payment. Risk passes on dispatch. Goods sold on credit remain Switchcom property until the invoice is settled.
Warranties
Vendor warranty applies as published by each manufacturer. Switchcom handles RMA on your behalf where the warranty is honoured by the vendor.
Limitation of liability
Switchcom's liability is limited to the value of the goods sold. We do not accept liability for consequential, indirect or lost-profit damages.
Governing law
These terms are governed by South African law. Disputes are subject to the non-exclusive jurisdiction of the High Court of South Africa, Gauteng Division. Nothing in these terms limits or excludes any right that a consumer has under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002.
